JB Hi-Fi Online Trade In Programme

JB Hi-Fi Online Trade In Program

These Terms were last updated on February 22nd, 2024.

  1. Introduction

 1.1 Welcome to the JB Hi-Fi Trade-In Program, operated by TIC (Reverse Logistics) NZ Limited. These Terms apply to your participation in the Program, including your use of our Portal.

1.2 These Terms include capitalized words, which have a specific meaning, that is explained in the ‘Dictionary’ in Part D below. Please note that these Terms also include our Privacy Policy (available on our Portal).

1.3 Please read these Terms carefully each time you visit our Portal. By accessing and using our Portal you are deemed to confirm that you have read, understood and agree to be bound by these Terms.  If you do not agree to any part of the Terms, you must not access, or must immediately stop accessing, our Portal and the Program.

1.4   If you have any questions about these Terms or our Program, please contact us using the contact details available on our Portal.

Some important information

These Terms contain important information that could affect you, and you should read them in full.  But here are a few things we think you should know up-front: in some cases, these Terms allow us to charge your credit card or debit card up to the amount of the initial estimate we give you for your Device.  For example, we may do this if you don’t deliver the Device by the due date or if we determine after receiving your Device that it doesn’t comply with these Terms or is not in the condition you indicated. We exclude responsibility for any data stored on your device.  You need to back-up your device and perform a factory reset before sending it to us. We limit our liability under these Terms to our estimated value for your device.

  1. Am I eligible for the Program?

 2.1 To be eligible to participate in the Program you must:

(a)  be:

        (i)  a New Zealand resident, located in New Zealand and able to ship your Device from within New Zealand;

        (ii)  at least 18 years old;

       (iii)  participating in the Program on your own account and for your own purposes (and not on behalf of any other person or for any secondary or commercial purpose);

(b) have an authorised credit card or debit card issued by a New Zealand bank in your name and complete a Pre-Authorisation Hold (refer to clause 8); and

(c) have a Device that:

      (i)  you purchased in New Zealand;

     (ii)  has not been subject to a recall in New Zealand;

     (iii) you own and are legally entitled to sell (without any obligations to any other person or business);

      (iv) is not lost or stolen and is not ‘Block Listed’ (that is, your Device’s unique identifier (IMEI number) is not blocked on any mobile network); and

      (v) complies with any other criteria or requirements notified to you on the Portal from time to time; an

(d) comply with these Terms in all of your engagements with us.

  1. How do I submit a Valuation Request

 3.1 You can submit a request for a valuation of your Device through the Program by following the process set out on the Portal (a Valuation Request).

3.2   To submit a Valuation Request, you must provide all of the information required on the Portal, including:

(a)    information about your Device, such as the manufacturer and model, as well as the condition of your Device; and

(b)   confirmation of whether you will include the charger with your Device (if your Device is a laptop or watch).

3.3 You must ensure that all details you provide to us in connection with your Valuation Request are accurate, up to date and not misleading.

  1. How is the value of my Device assessed?

4.1 Based on the information provided by you in your Valuation Request, we will notify you on the Portal or by e-mail of the estimated trade-in value (inclusive of GST) of your Device (Trade-in Value).

4.2 You can then choose to accept the Trade-In Value, and proceed with the Trade-In, by following the process set out on the Portal within the allocated time (Trade-In Request). This will include:

(a)  confirming that you comply with the Eligibility Criteria set out in clause 2;

(b)  providing an approved form of personal identification and following an identity validation process through our identify verification provider (refer to clause 8 for further details);

(c)  confirming your contact details, including your nominated email address to receive your JB Hi-Fi eGift Card and/or JB Coupon and your postal address if we need to return your Device to you (refer to clause 7); and

(d)  providing your payment card details to our payment services provider, together with a Trade-In Security Pre-Authorisation (refer to clause 8 for further details).

4.3 Once you have completed all of the Trade-In Request steps, we will confirm that we have accepted your Trade-In Request (Trade-In Transaction) and send you a JB Hi-Fi eGift Card with a value equal to the Trade-In Value and/or a JB Coupon, to your nominated email address. We will confirm to you whether you will receive a JB Hi-Fi eGift Card, JB Coupon or both before you complete your trade-in transaction. This JB Hi-Fi eGift Card and/or JB Coupon is the sole form of payment you will receive for the sale of your Device to us.

4.4 Any JB Hi-Fi eGift Card you receive is governed by the JB Hi-Fi’s Gift Card Terms and Conditions. Please ensure that you have read the JB Hi-Fi Gift Card Terms and Conditions.

4.5 Any JB Coupon you receive can be redeemed (before the stated expiry date) to get a one-off discount off the current purchase price of identified goods and/or services from JB Hi-Fi.

4.6 From time to time, we may impose a maximum aggregate value of Trade-In Transactions and JB Hi-Fi eGift Cards/JB Coupons within a specific time period.

4.7 We reserve the right to not offer you a Trade-In Value in response to your Trade-In Request or to cancel a Trade-In Transaction before you have sent your Device to us.

  1. How do I send my Device to you?

5.1 To complete your Trade-In Transaction, you must send your Device to us, in accordance with the delivery instructions we send to you as part of the Trade-In Transaction (and any additional requirements of your carrier, if applicable). For:

             (a) TVs, you can either bring that Device in to your  nearest JB Hi-Fi store in New Zeland or arrange to have it collected from you at an eligible NZ address, if you have purchased a new               TV from JB Hi-Fi with delivery included. JB Hi-Fi will facilitate the onward delivery to us; or

             (b) all other Devices, we will provide you with a pre-paid shipping label which you can print (or a shipping reference to use for postage).

5.2 You must ensure that:

(a)  the Device you send us complies each of the requirements set out in clause 2.1(c) and matches all of the details that you provided to us with your Valuation Request, including the manufacturer, model and condition of your Device (refer to clause 3.2); and

(b)  for:

        (i) all Devices other than TVs, we receive your Device at our nominated delivery address by the Delivery Deadline; or

                     (ii) TVs, you deliver that Device to your nearest JB Hi-Fi store in New Zealand or have it collected from an eligible NZ address (if you have purchased a new TV from JB Hi-Fi with                           delivery included).

5.3 You are responsible for any loss, theft or damage to the Device during delivery and risk does not pass to us until we confirm the delivery of your Device.

5.4 Without limiting clause 5.3, you are solely responsible for:

(a)  ensuring that you package your Device for delivery in a manner that protects it from any damage;

(b)  obtaining insurance for loss, theft or damage before your Device is delivered to us;

(c)  ensuring that your Device is in the factory reset condition with all data and SIM cards removed and screen locks, pin codes and activation locks disabled; and

(d)  keeping a separate backup copy of any data on your Device.

5.5 If you have not already done so, we will ensure your device complies with clause (c) following receipt by us and you acknowledge that we are entitled to do this.

  1. How is the Device assessed by TIC on delivery?

6.1 Once we receive your Device, we will assess the Device to determine whether it meets the Acceptance Criteria (refer to clause 5.2). If, in our reasonable opinion, your Device meets all of our Acceptance Criteria we will inform you of this by e-mail.  If, in our reasonable opinion, your Device does not meet any element of the Acceptance Criteria, we may elect to take any of the following steps, at our discretion:

(a)  notify you of a revised Trade-In Value (in which case clause 6.2 will apply); or

(b)  return the Device to you.

6.2 If we notify you of a revised Trade-In Value, you may:

(a)  accept the revised Trade-In Value, in which case the Trade-In Transaction will be amended to that value and you will be deemed to authorise our payment provider to charge your payment card the difference between the original Trade-In Value and the revised Trade-In Value; or

(b) reject the revised Trade-In Value, in which case we will return the Device to you and clause 7 will apply.   If you do not respond to a revised Trade-In Value within the time specified with the revised Trade-In Value (or, if no time is specified, within a reasonable time), you will be deemed to have rejected the revised Trade-In Value.

6.3 If we return your Device to you, we will send it to your nominated contact address (which must be an address in New Zealand). We reserve the right to authorise our payment provider to charge your payment card a reasonable amount (no more than $10) for packaging and postage.

  1. What if I don’t comply with these Terms

7.1 This clause 7.1 only applies where a JB Hi-Fi eGift was offered to you through the Portal, as payment for the sale of your device, before you completed the relevant Trade-In Transaction.

As outlined above, after we have accepted your Trade-In Request, we will send you a JB Hi-Fi eGift Card before we receive your Device. Accordingly, if we don’t receive your Device by the Delivery Deadline, or we determine (acting reasonably) that you do not comply with any other aspect of these Terms, we may (at our election):

(a)  ask you to correct the non-compliance (e.g., to remotely remove any screen locks or PIN codes);

(b)  agree a revised Trade-In Value with you, in accordance with clause 6;

(c)  cancel your Trade-In Transaction, return your Device to you (if we have received it) and direct our payment services provider to pay us an amount equal to the Trade-In Value, pursuant to your Payment Security Approval; or

(d)   deal with your Device in accordance with applicable law (including, if applicable, if your Device is Block Listed or we are not able to contact you) and direct our payment services provider to pay us an amount equal to the value of your JB Hi-Fi eGift Card, pursuant to your Payment Security Approval.

7.2 We reserve the right to prohibit your continued use of the Program, if you do not comply with these Terms.

7.3 We also reserve the right to cancel any Trade-In Transaction at any time (including after acceptance) if we subsequently determine that you have not complied with these Terms or that you are using the program to dispose of commercial volumes of products.

  1. Why are my payment card details required?

8.1 As part of the Trade-In Request process, you will be required to:

(a)  provide your nominated payment card details to our payments services provider, Stripe;

(b)  authorise a pre-authorisation hold against your nominated payment card (for credit cards) or bank account (for debit cards) equal to your Trade-In Value (Pre-Authorisation Hold);

(c)  complete an identity verification process (ID Verification), using Stripe’s identity verification tool.  As of the date of these Terms this involves taking a photo of an approved type of personal identification document and taking a “selfie”;

(d)  authorise Stripe to pay us an amount up to the Pre-Authorisation Hold, if we notify Stripe that we have a right to such amount in accordance with these Terms (Payment Security Approval).

8.2 If a Pre-Authorisation Hold is not granted or the ID Verification is not successful for any reason, you will not be able to proceed with the Trade-In Request (for example, if the relevant account does not have the funds necessary for the Pre-Authorisation Hold).

8.3 Please contact your bank if you have any questions about Pre-Authorisation Holds that you have approved. In particular, please note that:

(a)   we are not responsible for, and have no influence over, the time it takes for your bank to release a Pre-Authorisation Hold; and

(b)  a Pre-Authorisation Hold will be made each time you submit a Valuation Request using your nominated payment card.  In some cases, this may result in multiple Pre-Authorisation Holds – for example, if you submit Valuation Requests for multiple Devices or if you cancel and then re-submit a Valuation Request. We will not be responsible if by having multiple Pre-Authorisation Holds, your bank declines a transaction due to insufficient funds.

8.4 We will never see nor store the details of your nominated payment card.  Details of your nominated payment card are collected, stored and processed by our payment services provider, Stripe.

  1. When does ownership of my Device pass to TIC?

9.1 Us giving you a Trade-In Value is not to be considered an offer by us to purchase your Device at that value. Instead, if you provide a Trade-In Request (as contemplated in clause 2) this is an irrevocable offer by you to sell us your Device on these Terms.  Ownership of your Device passes to us:

(a)  at the time we send you an e-mail confirming that your Device meets all our Acceptance Criteria, as contemplated in clause 6.1; or

(b)  if we give you a revised Trade-In Value, at the time you accept that revised value, as contemplated in clause 6.2(a).

9.2 At the time ownership of your Device passes to us, ownership of any SIM card, memory card or data you have not removed from the Device will also pass to us, and we reserve the right to destroy any or all of them.

9.3 Even after ownership of your Device passes to us, we reserve the right to charge you the Trade-In Value or the revised Trade-In Value, as applicable (including by using your credit card or bank account (for debit cards)) if we discover that the Device does not meet our Acceptance Criteria, including if it has been reported as lost or stolen or if the Device is discovered to be a counterfeit.

  1. Do any additional terms apply?

10.1 We may notify you of additional specific terms and conditions on the Portal.

10.2 Please refer to:

(a)  JB Hi-Fi’s Gift Card Terms and Conditions – for terms and conditions that apply to your use of the eGift Cards.  The JB Hi-Fi eGift Card you receive can be used in all JB Hi-Fi stores in New Zealand (excluding its airport stores) as well as online via www.jbhifi.co.nz (or any replacement or additional website(s) as TIC may notify in future);

(b) any conditions relating to the use of any JB Coupon you may be eligible to receive following a trade-in, including as to the range of products the JB Coupon can be applied towards and the relevant expiry date. These restrictions will be notified to you before you complete the relevant trade-in. JB Coupons can be used in all JB Hi-Fi stores in New Zealand (excluding its airport stores) as well as online via www.jbhifi.co.nz (or any replacement or additional website(s) as TIC may notify in future), cannot be redeemed for cash and cannot be used in conjunction with any other coupon or promotion. Unless otherwise advised when you are completing a Trade-In Transaction, JB Coupons can only be redeemed once in connection with the purchase of one eligilble product from JB Hi-Fi; and

(c) Stripe’s terms and conditions – for terms and conditions that apply to the payment services available on our Portal.
